How to Appeal a ULEZ or Congestion Charge Penalty from TfL

Transport for London (TfL) issues millions of penalties each year for the Congestion Charge, Ultra Low Emission Zone (ULEZ), and Low Emission Zone (LEZ). Understanding TfL Penalties

TfL penalties are Penalty Charge Notices issued under the London Local Authorities and Transport for London Act 2003 and related legislation. They are civil penalties, not criminal fines, but they carry enforcement powers including debt registration and bailiff action if unpaid.

The standard charge for a Congestion Charge PCN is £160, reduced to £80 if paid within 14 days. ULEZ and LEZ penalties follow similar structures, though the underlying daily charges differ.

The Appeal Process

Step 1: Informal Representations

You can challenge the PCN by making representations to TfL within 14 days (to preserve the discount) or within 28 days. TfL's representations process is online at tfl.gov.uk.

Step 2: Formal Representations to the Adjudicator

If TfL rejects your representations, you can appeal to the independent adjudicator at London Tribunals (londontribunals.gov.uk). This is free, and the adjudicator's decision is binding on TfL. Hearings can be conducted by post, online, or in person.

Strongest Grounds for Appeal

Vehicle Not in the Zone

If you can demonstrate that your vehicle was not within the charging zone at the time alleged – through dashcam footage, GPS data, fuel receipts, or witness evidence – the PCN must be cancelled. ANPR cameras can misread plates, and occasionally assign a charge to the wrong vehicle.

Exemption or Discount Not Applied

Certain vehicles are exempt from ULEZ and Congestion Charge, including vehicles registered with TfL for certain discounts (residents' discount, disabled persons' exemption, NHS exemption). If you were entitled to an exemption that was not applied, provide your registration details and proof of eligibility.

Camera or System Errors

TfL's ANPR system processes millions of transactions daily. Errors occur. If the camera image is unclear, the number plate was misread, or the system failed to process a valid payment or exemption, this supports your appeal. Request the camera images from TfL – they must provide them.

Payment Made But Not Recognised

The single most common ground for successful appeals. If you paid the Congestion Charge but TfL's system did not record it, provide your payment confirmation – bank statement, Autopay confirmation, or app screenshot. System glitches are well-documented.

Mitigating Circumstances

TfL has discretion to cancel charges in cases of genuine hardship, emergency, or circumstances beyond your control. Vehicle breakdowns within the zone, medical emergencies, and being directed into the zone by police or traffic management are all recognised grounds.

Signage and Notification

The charging zone must be clearly signed. If you entered the zone at a point where signage was missing, obscured, or inadequate, this is a valid ground. This is particularly relevant for drivers unfamiliar with London or for new zone boundaries.

ULEZ-Specific Issues

The expanded ULEZ catches many drivers who were previously unaffected. Common issues include vehicles that should be exempt based on their emissions but are incorrectly classified in TfL's database, vehicles with retrofit equipment that has not been registered with TfL, and classic vehicles that qualify for the historic vehicle exemption but have not been registered.

If your vehicle meets the emissions standard but TfL's records show otherwise, you will need to provide evidence from the vehicle manufacturer or a certified emissions test.
